Please note that all Nomad Design products are handmade; from the fabric itself to the individual pieces. Consequently, you may find, what we call 'perfect imperfections' and you might call minor 'imperfections', these are usually results of the weaving and dyeing process. Nevertheless, we are happy for you to get in touch if you have any questions or think that your purchase is defective.

 

PRODUCT

Nomad Design has the right to adjust prices, include additional costs and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as far as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the watch. The pictures may differ depending on the colour settings on your computer. All pictures should be seen as illustrations only, and do not guarantee correct appearance and characteristics.

 

The term Nomad Design or "us" or "we" refers to the owner of the website. The term “you" or “client” or “customer’’ refers to the user or viewer of our website and the purchaser, customer, client and consumer of our product. The product refers to any item mentioned for sale on www.nomaddesign.co.uk.

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.

 

ORDERING

Orders made in another person's name without their consent, or any other financial damage suffered to that person or Nomad Design will be reported to the police. Nomad Design holds the right to change prices, correct incorrect prices on all orders as well as final sales. Nomad Design has the right to cancel any order at any time.

 

All attempts at fraud will be reported to the police and Nomad Design reserves the right to cancel the purchase if any suspicion is arisen. British law shall govern any dispute and any issues under these terms.

 

CONFIRMATION

Once we have received your order we will send a confirmation to your email address. Save this email in order to facilitate any contact with customer service. The order confirmation (receipt) also serves as a guarantee of proof of purchase.

 

PAYMENT

You can choose to pay with credit or debit cards using SagePay or Paypal. For payment gateway specific terms and conditions please see www.paypal.com or www.sagepay.com. Nomad Design does not handle any credit or debit card numbers. There is no extra charge for card payments. When paying by credit/debit card starting conditions apply as soon as the card transaction is approved.

 

The price of the Goods will be set out in our price list in force at the time we confirm your Order. Our prices may change at any time, but price changes will not affect Orders that we have confirmed with you. This includes foreign exchange rates which are fixed by us and may be subject to change without notice.

It is the customer's responsibility to adhere to their local tax regulations; this includes import duty and VAT. WE CURRENTLY DO NOT CHARGE VAT ON ANY OF OUR PRODUCTS. 

 

COMPLAINTS TERMS & WITHDRAWAL

It is important that you, the customer, checks their goods upon receipt of the shipment in order to verify that the products are not damaged and correct. If you receive your item and see that you have been sent the incorrect item or it is damaged, please contact Nomad Design within 14 days - georgie@nomaddesign.co.uk - +447833444304. Any complaints should be made to our customer service team via - email - georgie@nomaddesign.co.uk, or through the Contact Us form on the contact page of our website. 

Please supply the order number and the reason for your complaint and we will get back to you promptly with instructions on how to return the item. 

It is important that the product being returned is packaged in such a way that it cannot be damaged in transit. 

The customer is entitled to a refund of the shipping cost if the product suffers a manufacturer fault, which will be decided by Nomad Design on receipt of the returned product. We will refund you the minimum postage amount for the returned goods. Should you wish to choose a premium service the extra cost will be carried by you, the customer. Nomad Design has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund.

 

RETURN POLICY FOR ONLINE ORDERS

You, the client / customer / consumer, have 14 days within which to contact Nomad Design if you would like to make a return or exchange your order. 

You, the client / customer / consumer, are responsible for covering postage and packaging costs for any items you wish to return or exchange both ways. If you wish to exchange your item you must cover the cost of postage cost. If your item is faulty / you have been sent the incorrect item we will cover the minimum cost of the returned item and will cover the cost of the new item. Should you wish to choose a premium service the extra cost will be carried by you, the customer.

You, the client / customer / consumer, then have 14 days within which you must return the goods to Nomad Design. Subsequent to this your refund will be processed or your exchange sent to you within 14 days.

 

You, the client / customer / consumer has the right to cancel an order made online on the website www.nomaddesign.co.uk before the order has been dispatched. This right applies only in the case that the product and its original packaging can be returned in the same condition as they were received. This does not apply to any order made via email or any custom order.

The customer must stipulate the order number and customer’s email address that was used to order will be required. 

Return shipping costs will be paid by the consumer.

 

CUSTOM / BESPOKE PIECES

Under no circumstance do we accept any financial returns for custom order, unless the piece is defective, damaged in transit or made incorrectly. The client is responsible for making it clear about what they want and deviation from an original plan of work after a piece is finished.

 

LIABILITY FOR DEFECT

If your product is damaged in transport, whether the damage is visible or hidden it must be reported immediately to the carrier within 14 days. It is therefore important that you carefully examine your package when it arrives. Transport damage must also be reported to Nomad Design, within 14 days of placing the order. Defective products returned to Nomad Design will be treated as if they were in perfect working order when shipped as all our products are inspected when they are packaged before they are sent. In the case of faults or defects in the product supplied, the purchaser shall not be entitled to reject the product unless such faults or defects are reported within 14 days of placing the order.

 

As a consumer, you have legal rights in relation to Goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

 

LIMITED LIABILITY

Nomad Design's responsibility for errors in delivery is limited to these conditions of sale. Nomad Design bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.

 

Nomad Design shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered or delayed by circumstances beyond our control. As the release factor should be considered to include government intervention, new / amended legislation, lack of state, war, fire, flood, labour disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.

 

We only supply the Goods for domestic and private use. You agree not to use the Goods for any commercial, business or re-sale purpose, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

INTELLECTUAL PROPERTY RIGHTS

The rights in the designs and content of this website are owned by Nomad Design. Copyright and other intellectual property rights protect them. You may not copy, reproduce, modify, distribute display, post or transmit any part of this site without permission. All trademarks, product names and company names or logos featured on this website are the property of their owners.

 

RETENTION OF TITLE

All products remain Nomad Design's property until full payment is made.

 

APPLICABILITY

These Terms are governed by English law. You and We both agree to submit to the non-exclusive jurisdiction of the English courts. These conditions are applicable where the British or other applicable law do not provide conditions that are in conflict with them.
